The Alabama Legislature has voted to ban texting while driving

  • I've heard of cities that have done this and the accidents increased, people just hold their phones lower on the dash and farther from the road when they text to avoid being seen.

Those that give up freedom for safety, deserve neither freedom nor safety - Ben Franklin

So how do you feel about driving black-out drunk? Should we legalize that? Get rid of speed limits? How about remove stoplights and stop signs? We should be free to drive in any manner we want right, lest we demonstrate that we deserve neither freedom or safety, correct?

That's the argument you are making.

Tennessee has this law. Not hard to enforce it.

yep. Cameras are being installed everywhere. They will just start mailing tickets out. We were in Hawaii when they started the testing. It was VERY effective and EVERY SINGLE PERSON using a phone in a certain known "high use area" got tickets EVERY DAY at $100/pop, until they quit doing it. That gets pretty expensive.

These camera companies, who get a % of every ticket, are MORE than willing to put up cameras EVERYWHERE for free.

I'm all for it. I'm tired of nearly getting hit every day. I drive 15 mi. on 459 back and forth to work each day, and EVERY DAY there's an idiot swerving or driving erratically---always texting or on the phone....worst device ever invented to have in cars.

This will be one of those laws that most cops won't give two shits about enforcing.

They've enforced it in spurts in TN. Not hard to do. Most people have the phone in plain sight while driving.

phones emit RF which can be detected by devices...it ain't hard at all even if it can't be seen...much like radar.

Surprised to see people that disagree with this. If you drive in tuscaloosa on a regular basis, you'd be pushing for it to carry a $200 fine and a one month revocation of license.

I disagree with any and all laws that transfers power and wealth from the the honest hard-working people of this state to a criminal government. That's what this law is all about. It is a shameful power grab.

Just curious as to how they can prove you are texting and not checking a stock or picking a song from pandora or something. It only bans texting, Email, and instant messaging.

    ... or reading BOL.

    Guilty.

Exactly, another useless, unenforacable law, giving the government more control. Are people ever going to wake up? SMH

Are you ever going to wake up?

How does it give anyone more control if it's unenforceable?

phones emit RF when they're not being used as well

    faceman237

  • They'll more than likely enforce it through a complete ban on using a phone unless with a hands-free device (and even those are being proven not much safer in terms of distraction).

If you don't think the state government has the authority to enact a safety measure regarding public roads, not sure what to tell you.

And to compare this to Ben Franklin's quote is quite asinine. This isn't about some perceived danger and a consipiratorial power grab, this is a reactive measure that not only will save lives, but has been needed for a long time.

I guess I'm not understanding how the legitimate exercise of the state's constitutional and necessary police power (i.e. the power to protect health, safety and welfare of it's citizens) is somehow "big government." That power is fundamental.

This is no different than when people talk about the NCAA. The government isn't some seperate entity that functions in a collectively conspiratorial manner that is always driven to more control, more revenue.

  • once again, arguing about doing something that is STUPID to do while driving, is, well....stupid.

Do it if you want...but if you hit me or my kid, or my family, you'll never see anything but dark forever.

It seems to me that a lot of these "libertarian" "tea party" types need a remedial civics lesson.

We can start with the legitimate power of state government, derived from the people, to use coercive power (yes, coercive) to protect the health, safety, morals, and welfare of that state's citizens.
