The Alabama Legislature has voted to ban texting while driving

  • faceman237 said...

like if I'm sitting at a red light? Are your kids dumb enough to run under my tires when I'm sitting waiting for traffic to clear?

it will be legal to use while sitting still...although I still feel it shouldn't be on the roads altogether.

Do you not understand that your state and federal governments are robbing you blind???

Are you a ron Paul supporter? Curious.

I guess I'm not understanding how the legitimate exercise of the state's constitutional and necessary police power (i.e. the power to protect health, safety and welfare of it's citizens) is somehow "big government." That power is fundamental.

No it isn't. The role of government is NOT to keep people safe. The role of government is to protect the liberty and rights of the people. This law does NOT protect the liberty and rights of the people. It does the exact the opposite.

Ah man. I guess we should close the police departments, courts, military bases etc.

By the way, you don't have a right to use a cell phone on a public road. Same way you dont have a right to drink and drive on a public road or the right to drive without a liscense. Those stupid driving tests infringing on my freedom from government.

The police and the courts are part of the government. Thus, their duty is to uphold their oath of office and protect the liberty and rights of the people - not steal from the people. It is illegal for the military to engage in domestic police operations. Doing so violations the Posse Comitatus Act.

You broadly said keep people safe. Use better diction next time.

We speak English in this country. Perhaps if you lived something beyond football you would improve your comprehension skills.

So you didn't say that? Yea...by the way, you are still wrong. This law doesn't infringe on any liberties and rights because there is no right to talk on a cell phone while driving on a public road.

  • How is talking on a phone or using a hands free device any different than talking to the passenger sitting next to you? Is that the next ticketable offense? Whats the problem officer? Well sir I saw your lips moving. Gonna have to write you a ticket. Yes some states are banning hands free also.

I'd have to say using a phone for texting or holding while talking has caused more accidents than talking to a passenger.

I realize basic civics is beyond your level of comprehension, but I'll take a stab at explaining it to you nevertheless - futile as it may be.

In a free constitutional republic (like the United States of America) people have the right to do anything they want to do provided it does not infringe upon the rights of another.

    Like endangering fellow drivers.

Well I'd have to say that it hasn't. See how easy that was? I'd like to see some evidence that talking to someone in person is safer than talking to them through a microphone.

    Old Gregg

  • But anyway back to the ban on texting. That doesnt fix anything because it only bans texting and I rarely text and drive. I usually watch videos and surf the web. Thats still going to be legal. I'm so reckless and need the government to control me better.

I think talking to someone in the car and talking on the phone would be very similar except taking on the phone probably requires more attention in holding and using the phone (unless one had a hand free device).

    Here are some statistics.

Distracted Driving | Facts and Stats | Texting and Driving

Distracted driving is any activity that could divert a person's attention away from the primary task of driving. All distractions endanger driver, passenger, and bystander safety. Click here to learn more.

Thanks! Below is a short copy/paste from the link you posted.

""Distracted driving is any activity that could divert a person's attention away from the primary task of driving. All distractions endanger driver, passenger, and bystander safety. These type of distractions include:

    - Texting
    - Using a cell phone or smartphone
    - Eating and drinking
    - Talking to passengers
    - Grooming
    - Reading, including maps
    - Using a navigation system
    - Watching a video
    - Adjusting a radio, CD player, or MP3 player

Could you see all of these acts becoming illegal in the future, because If I can't eat the occasional burger or talk to my wife while driving then I may be in trouble. Lastly, why are two year olds not on that list?? (G)

So while I agree with the hands free law you have an issue with my use of big gov?

    Okay

  • Btw in CT state employees are exempt from the texting while driving and hands free laws.

Just thought id throw that out there

    GSay001

  • This is a good thing. I'm sick of people driving slow, swerving , being in the peoples way not giving a damn what's going on around them and when you finally get past them they are either texting, dialing,or talking on the cell phone. Now if they will just enforce it and the tailgating law! Drives me nuts when I'm going 79 in a 70 passing people it still isn't fast enough...always some jackass flying up on you. Slow distracted drivers and leadfooted lane hopping jerks are dangerous and need to be dealt with. After being hit from behind at 60 mph I'm passionate about this stuff!

phones emit RF which can be detected by devices...it ain't hard at all even if it can't be seen...much like radar.

I use my phone as a radio while i'm driving. I have either the XM app or the Jox app going nearly the entire time i'm driving. If they are just seeing if you are using data then I'm going to get pulled over a lot.

    scottchap

  • as it should be. too many people getting killed and injured. I think ANY phone use other than "hands free" should be banned while driving.

    Okay

I have a problem with this notion that a state government is somehow usurping it's power when it passes a law designed, on it's face, to protect the health, safety, or welfare of it's citizens.

That power (known as the "police power") is inherent in any state government and is granted, by clear implication, by the 10th Amendment of the United States Constitution. This is pretty well established and anyone who thinks otherwise needs a remedial civics lesson.

    bamazsmith

  • I don't text while I drive anyway, but I do frequently text while stopped.

I shouldn't get a ticket for texting while stopped at a light or at a train stop.
