I guess I'm not understanding how the legitimate exercise of the state's constitutional and necessary police power (i.e. the power to protect health, safety and welfare of it's citizens) is somehow "big government." That power is fundamental.

By the way, you don't have a right to use a cell phone on a public road. Same way you dont have a right to drink and drive on a public road or the right to drive without a liscense. Those stupid driving tests infringing on my freedom from government.

The police and the courts are part of the government. Thus, their duty is to uphold their oath of office and protect the liberty and rights of the people - not steal from the people. It is illegal for the military to engage in domestic police operations. Doing so violations the Posse Comitatus Act.

How is talking on a phone or using a hands free device any different than talking to the passenger sitting next to you? Is that the next ticketable offense? Whats the problem officer? Well sir I saw your lips moving. Gonna have to write you a ticket. Yes some states are banning hands free also.

I think talking to someone in the car and talking on the phone would be very similar except taking on the phone probably requires more attention in holding and using the phone (unless one had a hand free device).
