This is Ridiculous!

  • The University is still sueing Daniel Moore over his production of sports products. I hate this because ever since Daniel Moore created the goal line stand painting he has been apart of all big moments in Alabama's football history. He has sent all his children to the University and supported them finacially. I don't understand why our Universtiy is still persuing this? I am embarrassed by it honestly.

  • Does Alabama get any royalties from DM? I understand he's not doing anything with malicious intent, and I love his work and own two prints, but Alabama is just protecting their brand equity integrity.

    It's one of those "if we let Daniel Moore do it then we have to let everyone do it" type of things. Frankly he should realize this.

  • No flame, but OP is way off. So Alabama should let me starting producing black market Bama gear to compete with their licensed merch? Not only should you not be mad about the lawsuit, you should be in favor of the university you support not getting ripped off...

    I believe you are off base. He has been doing this for years and he isn't black marketing anything. He is creating ART not T-shirts on the side of the road. I am not in favor of this because I believe he has the freedom of speach on his side.

    Then you'd better not make any money from proprietary or copyrighted material... I agree with the University here. Just give the University a percentage Mr. Moore.

    I agree completely. I don't think anyone should be able to tell anyone what they can or can't paint just as they can't tell anyone what they can or can't write. Have to have artistic freedom.

  • CLC was started by ex-Alabama player Bill Battle working with Coach Bryant to structure a way to protect UA's trademarks.

    Moore could not have chosen a worse school to pick a fight with. Alabama has to protect itself if for no other reason than its the one who came up with the idea 30 years ago.

    Moore will...and should...lose this fight.

    I betcha for what those originals cost to buy he could probably afford to come to an agreement with University for using the lisence and this would all be solved. jmo

    Well the supreme court has sided with Moore on the issue already and he will win the issue again. The only thing the University is hoping for is to bleed him out is lawyers fees. That is the bottom line.

    Exactly. Not sure Alabama or any other university want to go down that road. It will cost them a lot more if they have to compensate players for stealing their likeness than they would get from Danny.

    If he does that then the university can control what he paints. If he paints an underclassman then the university has to sell them. That's unreasonable.

  • although I own some daniel moore works, the guy is hardly more than a tracer. It is somewhat garbage that he is making money without being licensed through the university, especially since he takes a picture or makes a collage of pictures, and then traces. Maybe I should start selling these "paintings" at ludicrous prices.

  • Do they still have his painting(s) in the Bryant Museum? Haven't been in there in a while, but I remember the huge canvas of The Sack inside.

    On a side note he could do a print of The Sack 2 and do a rendering of the Krystal's incident.

    You can paint whatever you want to. But when you start selling it and the only reason people buy it is because of the Bama logos and jerseys depicted in the painting we have a problem. The first amendment doesnt exist to let people rip off trademarks and to say so is nuts. Its illegal just like any other rip off like Prada bags and Rolex watches they sell for 100 bucks in NY. If you dont have permission to reproduce a trademark you are doing something illegal when you sell it. Moore can paint all the game scenes he wants and hang them in his living room, but thats not what hes doing. The university should get their licensing fee, and im betting they will.

    This isn't much different than what Smack Apparel does...except they do it with malicious intent.

    Smack wins lawsuits all the time...but usually ends up losing them. Their strategy is not much different than what you think the schools is...keep everything tied up in the courts until someone wants to stop paying for it.

  • I don't see how its any different than me designing a shirt on a computer (graphic art) and then selling it or any other T-shirt company. I can't do that so I see no reason he should be able to paint what he does without paying royalties. The reason he makes money on it is because of the success the football team has which is part of the University. Pay a percentage and move on.
