Torts - Why A&M isn't invited

To encourage one to breach an existing contract can result in a tort or civil wrongdoing and opens the one encouraging the action (breaching their contract) to a major liability. Thus, if A&M is in an existing contract with the Big 12 (10, 9, 8 or whatever it is today), then they must ON THEIR OWN ACCORD first exit their existing contract prior to being invited by the SEC to join. Whether you hope for or against expansion, no one is going to knowingly open up themselves to a lawsuit, and one that could probably be won - even by attorneys that graduated from the University of Texas...

Very interesting. I guess it's nice to have the legal eagles touching all the bases to keep a lawsuit from happening.

Not a lawyer but if A&M and the BIG 12 are in a contract with an expiration date of X then a contract offer from the SEC for X+ 1day would not create a problem. Then A&M would work to exit ASAP or fulfill contract and then move.

Thanks for the fresh perspective on this, doc. What I find most disconcerting about this whole thing is why/how it took a doctor to bring us info on contract law when, I would assume, we have several lawyers around who should have been on top of this sooner. Also disconcerting is this pain I'm having in my right testicle. Can you help with that, doc, or should I contact my attorney for a diagnosis instead?

Someone, I believe on twitter, basically said it amounts to the SEC saying "get your divorce finalized before you move in."

Agreed... Also, I think most of these conference contracts have a clause for this. Didn't Nebraska or TCU or somebody have to pay a fine or something like that? (I believe it was covered by the conference that took them) Maybe I'm making that up, but I thought there was an escape clause for most schools.
