What these young men did was terrible

    Yes, I think all of us who preach conservative values should realize the students who were robbed and beaten are the victims, not these players. They need to be gone from the University just as any student should be who engages in these type crimes.

    Well I preach liberal social values, and I think these guys are thugs who deserve to spend time in jail. I hate the prison industrial complex in America, but these guys are criminals, plain and simple. I'm not sure all the details (I've been partying in Nola for the last week straight), but if Eddie Williams and the others did it all, then they need to serve time. Alabama football players should be setting the examples of being a good citizen. Obviously they'll have some fun and do some stupid things, but this is on another level.

    I think we're all just saying that if you commit a Class B felony (or potentially a Class A), you need to go to prison without any sort of a second chance.

    This class of "mistake" is punished not so much as a punitive or correctional measure for the individual, as it is a deterrence to society. We punish petty theft and drug use lightly at the onset because we're concerned with fixing the criminal. But, people have to know that beating someone unconscious has serious consequences to protect potential victims. I can't justify believing that you should be able to beat someone with the potential of killing them and not face full consequences.

    That might be what you are saying, but their post stated repeatedly "mistake, blah, blah, blah", ""that is not a mistake, blah, blah, blah" implying that I had stated that those young men had just made a mistake when in reality I called their action felonies!

    I have lived my whole life with criminal defense lawyers and law enforcement officers and I truely feel that IF this is their first offense, prison would be the kiss of death for them. First offenders, even in manslaughter cases, offend get the opportunity to plea down and not do jail time.

    I don't care if they are football players or the boys down the street, if they have not been in trouble before, they should not go to jail. Downvote me all you want, but I think prison would ruin them.

    Please take the time to read my post correctly before you comment on it incorrectly. I said we all make mistakes, but this action by these young men were felonies NOT just mistakes. If they are repeat offenders they should do jail time, if not, then other forms of punishment might be more appropriate and benefitical for them. Get off your soap box

    Your first damn sentence was you hoped these thugs got a second chance at a Junior College with NO JAIL TIME!!!!!!!!

    Why don't you just pat them on the head..buy them some ice cream....and make them promise...better yet...make them PINKIE SWEAR... never to act like bad little boys ever again???

    Hell there are many offenders who go out a murder someone, plead down to manslaughter and get no jail time. If these kids have no record, they shouldn't go to jail for class B felonies.

    Go ahead and throw them under the bus, I prefer to try and give these young men a second chance at life. Maybe it is the mom in me or maybe it is my life spent with family in the criminal justice field and I know what will happen to these boys if they are sent to jail!

    These are young men...who after AT LEAST a year of seminars and behavioral training from some of the BEST SPEAKERS and coaches of young men in the known UNIVERSE....made the premeditated decision to inflict harm on another human being.....

    So we disagree on the course of action that should be taken regarding these young men. Neither of us disagree on what they did what was a horrible act.

    The problem these days is that when people disagree with anothers point of view they come out swinging and attacking rather than trying to engage in conversation and trying to understand why someone might think the way the do.

    Exactly. This wasn't even somebody who they had a pre-existing beef with or anything like that. Heck, I could make at least a little sense of that. This was just random violence against a completely innocent person. After they serve their debt to society in jail, then maybe they can have a second chance.

    Would the mom in you feel different if the victim was one of your childen? Not being sarcastic, but asking an honest question. If your child was punched unconscious, robbed, then kicked in the back and ribs, and woke up bloodied and struggled to a friends house with no recollection of what happened, would you feel the person who committed the crime deserved jail time? If the victim was your child vs an anonymous student, I think you would feel different.

    The Mamabear would want to go out and make them pay dearly for what they did, however, I would not do that.

    If this happened and the boys that did were basically good kids that had not been in trouble and were remorseful I would not want them to go to prison. If there was a chance that they could get their lives on track, I would rather have 4 young men on the right track rather than going into prison and getting on the wrong track.

    BTW,I support crimianls going to prison who really reserve it. I have been the victim of a violet crime, the most violent crime against women that there is, and the guy had been convicted of the same crime 10 years before and was paroled 1 week before he attacked me. I testified and wanted him sentenced to life. So I am no softy on crimials, but just see this situation differently.

    Nah....just scold them....make them write "I will never do this again" 500 times on a chalkboard....and send them on their merry way.....

    (Of course...if they complain that their hand is hurting after only writing 75 or so...we could probably let the rest of those 500 sentences slide)

    Mature conversations in my world don't include letting armed robbers who beat their pray into a pulp get off with a warning and a free college education at a Junior College....

    So they were armed now? Do you know the definition of "armed robbery"? Because all the reports I read there was never a mention of a weapon.

    Well...I do have a Bachelor's degree as well as a Paralegal degree....but feel free to include the definition of armed robbery if it makes you feel better....

    I thought that because Williams got in trouble on Sunday for having a gun without a permit. that his dumbass had one when they beat, tortured, and robbed the student....

    If not...this is what would be called a MISTAKE....my assumption that they brandished a weapon during their "misunderstanding"

    As opposed to beating the shit out of somebody...and calling it a whoopsie...and wanting to give these sweet, misunderstood children a do over.....

    I never read anything about about them using a weapon and therefore making it "armed robbery". Maybe one of was involved with something earlier, I have no idea.

    Everyone should get a second chance and their second chance I hope will be something like no jail time and to play at a JUCO school and prove themselves.

    We have all made mistakes, I know I have made too many to count, but never were any of my mistakes felonies. I hope they get their second chance, but I don't think they should get another bite at apple.

    Reread your first sentence....

    Your recommendation of NO JAIL TIME...and that they be able to play at a JUCO to "prove themselves" is all I needed......

  • I also want to point out that they would have to "plead out" of the charged crime altogether down to a misdemeanor to avoid time. Given the facts, and an apparent admission, I see no reason why a prosecuting office would do so.

    Via 13A-5-6 of the Code of Alabama, mandatory punishment is:
    "(2) For a Class B felony, not more than 20 years or less than 2 years."

    If convicted of a Class B felony (Assault 1, Theft 1, Robbery all apply here), they face mandatory jail time under Alabama law. There is indeed some confusion on if a gun was present, which would significantly up the sentence, again mandated under law.
