I see both sides of the argument. I may be uninformed on this, but I'm surprised that he hasn't been sued by any players that are in his painting. I'm curious as to what you guys think.

We touched on it last time this topic cropped up, but an athlete's likeness can't be used as a trademark. Basically, artists can paint historic events without infringing on TM rights. Look up Tiger Woods trademark case. So athletes probably wouldn't have a claim.
However, that's separate from the issue here: Whether the University's football uniform and image are protected. I think they are, but I have a feeling the court will side w/ Danny-boy.
