bama. since he's selling it, he needs to pay.

Got you an up vote. Also I am with Bama. This is licensed stuff, you cant sell any licensed stuff without paying to the one who licensed it. If I was to paint a picture with all great athletes that wear Nike, and it sold a bunch of copies I a sure I would be contacted by Nike to pay them some dough.

I see both sides of the argument. I may be uninformed on this, but I'm surprised that he hasn't been sued by any players that are in his painting. I'm curious as to what you guys think.

I am squarely on Daniel Moore's side. He has been painting Bama events long before the University and the rest of the colleges horned in on an entrepreneur's efforts and demanded a fee for using their image. To me that is a crock of garbage. If the university wants to put out an effort and come up with a good idea and create a t-shirt or a painting or a coffee cup let them do it and sell it. We the taxpayers fund the university and it is part ours, it's like charging us for our own property. The elites in the university don't know enough about the real world of commerce, they only know how to mooch off of the talents of others. I would love to see Daniel Moore sue the university for $50 million and collect. I detest moochers which is what the university presidents are in my estimation.

Are you serious? Do you understand the implications of something like that? Say, for example, I invent a line of Big Al toys and label them "Official Alabama Merchandise" complete with all the associated logos. Then it turns out these toys break and kill children. Who gets in trouble? Me? Nope. Alabama? You're damn right. Is it about the money? Of course it is. But it's also about making sure anything with YOUR logo and YOUR brand on it is regulated because YOU still own and license it. This is no different than any corporation protecting their brand in the same fashion.

  • Anything that has the Alabama script "A" on it has to be cleared and paid for. I manage a restaurant in Tuscaloosa, and we had the script "A" on some coasters. An Alabama Athletic department employee ate at the restaurant. I then received a call tell me that I had to get rid of the coasters or pay the University to make them for me. Apparently we were doing some sort of licensing infringement. Therefore I can understand where Alabama has a problem with the paintings. That all being said, Daniel Moore has been told for years that he needs to pay his fees for the paintings he has done. He ignores them and makes money off the university and that is the problem. Daniel Moore is in the wrong the same way Alabama would be in the wrong for selling jerseys with players names on the back. Its a dumb rule, but its still a rule and breaking them has consequences.

For one thing Daniel Moore does not label his paintings as "official Alabama memorabilia", he created the painting with his own efforts. If you on the other hand created a "Big Al" toy and labeled it as official memorabilia then you would be lying unless you were working for the University. I am not against someone getting a logo and protecting his property but give me a break, the University is a state institution and it is all about a money grab on their part. I bet that you don't know that they can deny you the opportunity to sell a product if they think that your product is not needed in the market place. Is that free enterprise? Of course not. I believe in a free market and the guy with the best t-shirt wins. If the university is so good get their artists and economic professors to come up with a product that the public wants. They can't do it, all they want to do is take money from you with an idea that you created. Think about it, you are either a producer or a moocher/looter. decide which camp you'd rather be in.
